Ministerial Decision A.P. 37271/21-6-2024
The Ministerial Decision A.P. 37271/21-6-2024 provides that, due to employee oversight, it is possible that the digital work card may not be registered at the start or end of the employee’s shift.
In such cases, up to three single declarations per employee per month are accepted without the imposition of a fine.
If the Labor Inspectorate identifies more than three such incidents per month, the company may be subject to inspection by the relevant authority.
Information & Monitoring for Single Entry/Exit Records
If an employee has orphan entry or exit movements, the following procedures apply:

You will receive a “C6 Single Clock in/out” notification, which informs you daily at 12:10 PM of all single declarations from the previous day for all employees.

You can also check this information in the application under Reports → Orphan Movements.
In case single entry/exit movements are detected:
A. Check if the movements have been submitted to the ERGANI system
(Open the “Check In – Check Out” form and verify if an ERGANI code exists).
Some declarations may not have been sent due to submission errors or ERGANI system malfunctions.
If you find movements that were not submitted, classify and resubmit them.
B. Check for pending movements on the time-tracking terminal or the CardScanner that have not been connected to SmartErgani.
If pending declarations exist, synchronize them with SmartErgani and verify successful submission.
C. Remind and alert the specific employees involved.
D. Enable notifications to monitor attendance and departures:

To be notified if an employee has not arrived at work: activate the alert “C1 No Arrival” or “C5 No Arrival with Tolerance.”

To be notified if an employee has not departed from work: activate “C2 No Departure”, “C3 Overtime Limit Reached”, or “C4 Extended Overtime Limit Reached.”
E. You can also enable notifications for failed submissions to ERGANI:
“D1 Submission Failure to ERGANI due to Data Error.”
In each case of submission failure, you will receive a notification such as:

The employee’s Tax ID (AFM) does not match the surname according to AADE records.

The branch number is incorrect.

The movement is late, and a reason for delay must be provided.

F. You may activate automatic submission of delayed movements via:
Settings → Company → Other.
This ensures that if there is a temporary network disconnection on the CardScanner or terminal, once the connection is restored, all movements are automatically transmitted to ERGANI with a “delayed submission” justification.

It is strictly prohibited for the employer to unilaterally start or end an employee’s daily work time record (forced clock-in or clock-out).
